Essay on Personal Property
Property can have sole ownership or pure ownership this is a single individual have a complete interest in property. There is also a joint tenancy where two people have equal interests on the property in question. The third case of ownership is the joint tenancy with right of survivorship, tenancy in common as well as community property. Most of the time when one wants to apply for the registration of property they register with the title obsolete. The title obsolete is where when one wants to re-register for the first time the registry checks the old unregistered documents that the applicant has and ensure that the applicants have a good title of the property ownership. Different states have different laws concerning the abandoning circumstances. One such circumstance, when a possessory product can be abandoned, is where one gets the obsolete title ownership.
As explained above one may not get the obsolete title ownership unless they have the old unregistered title of the property. However, if one gets the personality title and he holds it for several years then they finally gents the obsolete ownership of the property. The years vary in accordance with the law of different countries, Countries like USA and Britain prefers twelve years. This is the rare case because if one has kin the property is automatically transferred to them. For example, if one is lawfully married to someone and they do not have children then when he dies all his property are considered to be the wife’s belonging. However, this can be altered if the person had written the will to anyone other than his wife. In case there is no next of kin and there is no will to decide who should own the property after the death of the owner the property is considered to be completely abandoned.
Such a case is very rare to happen in the modern days but the law is stipulated if it happens. Both cases should involve a certified government lawyer. The person then should write a will to the respective charity they wish to live the property to. Despite this still, different countries have different laws concerning the abandonment of such properties. Finally, the possessory title property can be abandoned with the command by the judge. This mostly happens when there is someone else claiming the ownership of the property in question. Therefore, the government takes care of the property until the right owner is determined. Once the complainant is determined to be the owner then the initial owner is evicted from the land and it is given to the new owner. Sometimes in case, both complainants do not have enough evidence on the ownership of the firm then the judge may fail to determine who is the real owner of such a property.
In this case, the judge may decide that the land remain to be the government property or maybe any other choice that he or she may choose to give. The other situation applies when a person dies and has the property. James had the possession of property ownership and after his death and willed the property to his five sons. Then after the sons have the property Ms. Mary comes with the original absolute document proving that the land in question is hers. Therefore, the willed people will have to give back the property to the rightful owner. This applies to all situation above even if the property is sold by the government. Whatever the landlord may decide to know there can be no rules or regulations preventing him from doing so.
Justification of the law of abandonment. The law of ownership the possession ownership of the property can be justified in several ways, for example, the law of ownership where the property is taken back by the government when there is no one to own the property is just because such a property should be owned by everybody. The government is the only institution with the right channel to make sure that everybody benefits from such a property. For example, the government can decide to sell the property and provide some basic necessities that the community needs such as construction of roads to encourage the community development. If people sell property with possession titles and the one they have sold to is considered to be absolute property then people would always have the claim of the property get possession ownership once they get the ownership then they sell the property to other people who get absolute ownership.
Once the one who bought the property are given absolute ownership then in case the owners appear then the property already have a new owner and they cannot repossess the property that was initially there’s. Finally, the rule on tenants is justifiable because unless one is paying the rent one cannot live their belongings one someone’s property. First of all, it is blocking a person’s investment because one is not paying. The period offered by the law is enough for one to take away their property no matter how much many they are.
