Employment Discrimination Essay
Under the principles of vicarious liability, the Bike Across Iowa (BAI), can be held vicariously liable for the actions committed by one of its employees under the state and federal laws. Section 2000e- 2 of the Civil Rights Act, 1964 prohibits gender profiling/ discrimination of job applicants. Consequently, Section 102 of the Civil Rights Act of 1994 provides that an employer who has been found liable for discrimination shall face punitive measures that include monetary compensation to the complainant, fines, and compulsory hiring of the complaining party, or face all the aforementioned punishments. Additionally, BAI has infringed Part VII of Iowa Principles, and Practices for Charitable and Non Profit Excellence which advocates for non-discrimination of job applicants. At this juncture, BAI options are limited until the complainant files a formal complaint with the Employment Opportunity Commission (EEOC).
