There is a close relationship between the human rights and the state. We all agree that these rights are fundamental in order to have a harmonized international society. Human rights are universal rights shared by all people of different age, race, religion and even sex. This implies that they are universally accepted as fundamental human privileges1. Because of this, “Universal Declaration of the Human Rights”2 a document that contained and stipulated these was passed in the United Nations in the year 19483. These include the violations of human rights. The best way of looking at how the human rights are violated is from religion tradition perspective. International law of human rights might pose serious challenges to the traditions of the religions. However in this article, the challenges will only be looked at from the angle of those which arise as state works with human rights activists.

The state may interfere with human rights agencies either through supporting them or in as an obstacle through regulations. This research aims to find out how the state and the human rights agencies can collaborate in upholding human rights in America. About Human Rights Organizations Human rights organizations protect and uphold human rights and trying to end any abuse that is against these fundamental rights. They reach out to many people through social media and even their websites. They document incidences of violation of human rights and calling the government to action. They include the Amnesty International, Children’s Defense Fund, Human rights Action Centre, Human Rights watch, Human Rights without Frontiers, National Association for the advancement Colored People8. Because of this, the space for these movements have been reduced or even closed down.

This can be proved by the fact that many countries are withdrawing their membership from the International Criminal Court (ICC). This court deals with prosecution of the people who are involved in violation of human rights. The case is not different for the regional and United Nations institutions which are under Constant pressure from the leadership of various countries. There is thus need to rise against this populistic challenge in the United States of America. The American-Indians were forced westwards losing their lands, homes and even their lives. Women were denied voting rights16. They were also stripped off their rights to own land and even to serve on juries. However the feature of the self-correction of the democracy has been important to advance human rights among the marginalized people in America.

These problems extended to cold war times. The skeptic declared the “end times” of the project of the international human rights. This cessation was argued on the basis that Euro-America was responsible for the imposition of the human rights. They thought that putting to an end the Pax Americana will also end the human rights movement20. America is no different from the rest of the countries. There are so many cases where the Human Rights societies are subjected to the government control. He interfered with independence of media and federal courts which were likely to block some of his actions24. Donald Trump has frequently coddled the leaders who are autocratic. Some groups like ethnic minority, the members of particular races, the children, prisoner, immigrants and the poor are likely to suffer.

This is because they are least able to defend themselves. The internationally recognized laws on human rights are also continually being violated through the longstanding laws that are related to the juvenile justice, national security, national security and criminal rights25. They are likely to gain support from various stakeholders in US including local, federal and the national government. This promotes dignity, fairness and equality and basic needs of Americans through inherent interrelationship between the political, social, economic and cultural norms. Human rights framework is likely to place affirmative obligation American government to protect, respect and fulfill these rights. The duty to respect implies that the government cannot take an action which curtails or interferes with people’s enjoyment of their rights.

The duty to protect means that the government must safeguard groups or individuals so that their rights are not abused by any third party. USA ratifies International Human Rights Treaties Through broadening the collaboration, the human rights societies have propelled the United States Government to signed important international treaties about the human rights. So far, it has signed and ratified three human rights treaties while it is yet to ratify three other after signing them. The following were signed and ratified i. The international Convention on the Elimination of All forms of Racial Discrimination (ICERD). This treaty protects the Americans whether whites or the black Americans from being discriminated in economic, social, healthcare, housing and political participation33. They become the baseline for the human rights communities and activists to hold the government of the day accountable whenever they act contrary to them.

There is also the principle of the dedicated staff. The federal implementation and monitoring body should have the staff that can easily liaise with the municipalities and state. The US civil commission and human rights commission ensure that the human rights department is working in harmony with the state. They receive, suggestions, recommendations and reports from the local and states human rights commission about the matters of concern which fall within their jurisdiction37. This is a grant project that is directed to the students in various schools together with the communities in order to have an integrated program that which advocates for a healthy childhood development through discouraging unhealthy life like use of drugs like alcohol as well as discouraging violence in the communities.

The program also fosters coordination with programs that operates at a community level like juvenile justice agencies, boosting local education agencies among others. These seem like minor efforts though they are very important in ensuring that life of the local people is well advanced in the society41. The NGOs may advocate for the international human rights at the United Nations. Each of the above systems varies in terms of the mechanism used in approaching a particular human rights issue. It can also be trough specialized agencies like the rapporteurs. In order to come up with a particular policy or for the UN to enforce a particular treaty, they go beyond reported cases of violations of human rights. Its agencies regularly monitor compliance with obligations of the treaty.

The monitoring and reporting can be done in three ways a. State reporting - any state which has ratified the treaty is required to report how they themselves are complying to the treaty. In the case of America, the signing and ratification of various international treaties leaves the federal government with no option but to adhere to the conditions of the treaty which enhances human rights. The United Nations through its branch of United Nations Human Rights Commission has also been instrumental in advocating for human rights in America and all over the world. Apart from this international intervention, it is important that the Human rights Commission be able to work in collaboration with various agencies like the state, federal, the local people among others in order to achieve their objectives.
